Acceptance of Terms

Welcome to UrbanTok, a digital content and social platform where creators in Kenya monetize there content without stumbling over follower threshold requirements or barriers. By creating an account, streaming, uploading, or using our services, you agree to be bound by this Agreement, and all related policies, including our Privacy Policy and Community Guidelines. We may update or modify these Terms from time to time. Continued use after any update constitutes acceptance of the revised Terms. If you are creating content, monetizing content, or participating in affiliate/referral programmes, you are bound by both this Agreement and any separate Creator Agreement.


 

Eligibility

  • To use the platform, you must be at least 18 years old. You must have the legal capacity to enter binding agreements under the Laws of Kenya.
  • Any Users aged 13–17 years, or below may use the Platform under parental consent and supervision.
  • Accounts previously suspended or banned may not be reinstated without written approval.

 

Account Registration

  • To access creator features, monetization tools, or chat functionality, you must create an account.
  • You agree to provide accurate and current information, including your legal name, contact details, and payment information.
  • As a creator, you  are responsible for safeguarding your login credentials, and  the company may not be liable in case of any damages due to shared credentials on devices that do not belong to the creator
  • Creator are prohibited from selling, transferring, or sharing your account without our written consent so as to facilitate ownership migration and transfers
  • We reserve the right to reclaim usernames or suspend accounts for inactivity, impersonation, or violation of our Terms.

 

 

 User Content & Ownership

  • User Content includes any videos, streams, photos, music, chat, or text uploaded or broadcast through the Platform.
  • As A creator, You retain ownership of your content. However, by uploading, you grant UrbanTok a worldwide, non-exclusive, royalty-free license to host, stream, promote, and distribute your content through our services and for promotional purposes.
  • You confirm that your content:
    • Does not infringe on any third-party intellectual property rights.
    • Does not contain illegal, defamatory, hateful, or explicit material.
    • Complies with the Kenyan Penal Code, Communications Authority of Kenya regulations, and Media Council of Kenya standards.

We reserve the right to remove or restrict any content that violates these Terms or our Community Guidelines.


 

Monetization & Revenue Share

Earning and revenue policies is majorly fan driven and will be distributed as follows;

Creator Revenue

  • Creators may earn income through:
    • Advertising revenue
    • Subscriptions
    • Tips or gifts
    • Affiliate sales and referrals
    • Sponsored content or brand collaborations

Revenue Split

  • Creators receive 70% of eligible revenue. UrbanTok  retains 30% as an operational and platform fee.
  • Creators participating in the affiliate/referral program earn an additional 5% affiliate commission from qualifying referrals.

Payments & Taxes

  • Payouts are made in Kenyan Shillings (KES) via approved payment channels e.g. M-Pesa, PayPal and bank transfer.
  • Creators are responsible for declaring and remitting any taxes to the Kenya Revenue Authority since they are individual individual entities and not a company liability.
  • The Platform may withhold payments in cases of fraud, charge-backs, or violation of Terms.

 

 

Community & Conduct Rules

Creators and users must:

  • Treat others with respect; no harassment, bullying, or hate speech.
  • Avoid content involving nudity, explicit sexual activity, or illegal acts.
  • Not post misleading, fraudulent, or violent material.
  • Not use bots, fake views, or engagement manipulation tools.
  • Not promote gambling, scams, or unlicensed betting activities.
  • Not stream copyrighted material music, as, but not limited to the following; tv shows, movies and film etc without permission.

Violation of these rules may result in suspension or termination of your account.


 

Affiliate & Referral Program

  • Creators can refer new users or creators using unique personalized affiliate links. There after, A 5% commission applies on verified monetization revenue generated by referred creators or users.
  • Fraudulent referrals or self-referrals will result in disqualification and forfeiture of affiliate earnings.
  • Affiliate terms may be adjusted or withdrawn with notice.

 

 

Termination & Account Suspension

UrbanTok may suspend or terminate your account if:

  • You breach these Terms, our Community Guidelines, or Kenyan law.
  • You engage in fraudulent, misleading, or prohibited activity.
  • You fail to comply with payment or verification requirements.

Upon termination:

  • All access to your account and monetization tools ends.
  • Pending balances may be withheld subject to investigation.
  • Certain content may remain on the Platform for legal or promotional reasons.

You may voluntarily delete your account by contacting support, provided all obligations are settled.


 

 Intellectual Property

  • All Platform software, trademarks, and branding are owned by UrbanTok.
  • You may not copy, modify, reverse-engineer, or distribute our platform or code.
  • Copyright infringement claims will follow Kenya’s Copyright Act (2001) and international DMCA standards.

Privacy & Data Protection

  • We collect and process personal data in compliance with the Data Protection Act, 2019 (Kenya).
  • We may collect data for account creation, analytics, monetization, and security.
  • We do not sell personal data to third parties.
  • Users have rights to access, correct, or delete their data by contacting us.

Disclaimer & Limitation of Liability

  • The Platform is provided “as is” and “as available.”
  • We do not guarantee continuous, error-free, or secure access.
  • To the maximum extent permitted by law, Urban Tokis not liable for indirect, incidental, or consequential damages.
  • Our total liability to you will not exceed the total payments made to you in the previous three (3) months.

Governing Law & Dispute Resolution

  • These Terms are governed by the Laws of Kenya.
  • Any disputes shall be resolved through negotiation, and if unresolved, submitted to arbitration in Nairobi under the Arbitration Act (1995).
  • Parties may only proceed to court after arbitration has failed.

General Provisions

  • Entire Agreement: These Terms, the Creator Agreement, and our Privacy Policy constitute the full agreement between you and the Platform.
  • Relationship: No employment, partnership, or agency is created between creators and
